We've all hear or read about the case where some girl was grabbed in a parking lot and found dead a few days later. The abduction was caught on video, the suspect confesses, and the evidence supports it, but the suspect is either found not guilty due to mental illness, released on a technicality, given a life sentence with a chance for parole in a few years, or still sitting on death row.
In this and similar murder cases it is absolutely unacceptable and unfair to the victims and their families. First we change "not guilty" due to mental illness to "guilty" due to mental illness. Secondly, after the guilty verdict is given out there should be an automatic appeal; however, the appeal process is not to determine if this person's rights were violated, or if maybe one of the numerous people involved in the case may have made a technical or typographical error. No, the appeal process should be a very intense look to determine if there is any possibility that the suspect may not have committed the crime. All evidence, including all that was thrown out will be made available to the reviewers. Finally no one will be given the death sentence that was convicted on circumstancal evidence.
If the appeal process finds the person did not commit the crime the person is immediately released.
If the appeal process finds strong evidence that the suspect did the crime, but if there is any possible doubt (circumstancal evidence convictions), the suspect is put in the five year program or a life time mental institution.
If the appeal process agrees with the court verdict of guilty, the person is executed within two days. Remember this person didn't give their victim even that much time.
